25년 1월 14일 발표된 임시거주자의 가족구성원을 위한 오픈웍퍼밋 변경 규정 업데이트(25년 1월 21일부터 시행)

지난 1월 14일, 배우자의 오픈웍퍼밋 변경안에 대해 공지드리면서, 1월 21일부로 세부메뉴얼이 발표될것이라고 안내드린바 있습니다. 이에 관한 내용 정리해드리겠습니다.

 

 

1월 21일 UTC 타임기준 오전 5시부로, 캐나다 임시근로자의 배우자(및 자녀)의 오픈웍퍼밋 규정이 변경되어 적용됩니다.

 

 

2025년 1월 21일 이전에 신청하는 경우:

▶2025년 1월 21일 이전에 접수된 모든 신청서는 계속 처리됩니다 .

▶기존 오픈웍퍼밋 허가가 이미 승인되었고 만료되지 않았다면, 그 허가는 유효합니다.

 

1) 주신청자의 다음 카테고리중의 하나로 영주권을 진행했으며, 이로 인해 배우자가 오픈웍퍼밋을 신청할 수 있는 경우

 

－Agri-Food Pilot

－Atlantic Immigration Program

－Canadian experience class

－Caring for children class or caring for people with high medical needs class

－Federal skilled trades class

－Federal skilled worker class

－Holders of a Quebec Selection Certificate (CSQ) who applied for PR including:

－Quebec skilled worker class

－Quebec investors program

－Home Child-Care Provider Pilot and Home Support Worker Pilot ? Direct to PR stream

－Provincial Nominee Program

－Rural and Northern Immigration Pilot Program

－Start-up business class

 

이때 주신청자는 employer-specific or open work permit 을 소지해야 하며, 가족구성원의 오픈웍퍼밋 신청당시 주신청자의 취업비자가6개월이상 유효해야합니다. 

 

2) 주신청자가다음 프로그램의 요건에 부합하기 위해 취업비자를  소지함에 따라 배우자가 오픈웍퍼밋을 신청할수 있는 경우

 

－Provincial Nominee Program

－Provincial business candidates or Quebec self-employed applicants approved for a CSQ seeking eventual PR

－CSQ holders currently outside Quebec

－Quebec investors

－CSQ holders currently in Quebec

－Start-up Visa Program

－Atlantic Immigration Program

－Agri-Food Pilot

－Yukon Community Pilot

 

3)주신청자가 취업비자를 소지함으로 인해, 배우자가 오픈웍퍼밋을 신청할 수 있는 경우;

 

* 1월 21일부터 이 카테고리에서는 배우자나 법적동거인만이 오픈웍퍼밋을 신청할수 있습니다(자녀불가).

* 만약 현재 여권유효기간등으로 인해 배우자가 주신청자 비자의 유효기간보다 짧게 비자를 받은 경우에는 예외 규정을 적용받아 연장할수도 있습니다.

 

 

* TEER 4, 5에 해당되는 직업군에 종사하는 주신청자의 배우자는 오픈웍퍼밋을 신청할수 없습니다. (일부 영주권 신청 중인 경우 제외)

* 배우자의 오픈웍퍼밋 신청시 주신청자의 비자가 16개월 이상 남아 있어야 합니다.

* 배우자의 오픈웍퍼밋 신청 가능한 주신청자의 직군리스트는 다음과 같습니다.
